The Construction workers are one of the largest segment of the unorganised sector in India. More than 74 million workers are employed in the construction sector in the country. The sector’s contribution to the country’s GDP is around 9%. The construction sector is the second largest employer in the country. Although the provisions of various Labour Laws like Minimum Wages Act 1948, Contract Labour (Regulation and Abolition) Act 1970 and Inter-State Migrant Workmen (Regulation of Employment and Conditions of Service) Act 1979 etc. are applicable to the building and other construction workers, a need was felt for a comprehensive and specific legislation for the safety, health and welfare measures of construction workers and in 1996, Parliament enacted the Building and Other Construction Workers (Regulation of Employment and Conditions of Service) Act, and in accordance with the above, Government of Kerala notified the Kerala Rules 1998 and thereby the Kerala Building and Other Construction Workers Welfare Board came into being on 1998. Consequently, Kerala Building and Other Construction Workers’ Welfare Board was established by the Govt. of Kerala in the year 1998 under the provisions of The Building and Other Construction Workers’ (Regulation of Employment and Conditions of Service) Act 1996 and the Kerala Rules 1998 thereon. The Kerala Building and Other Construction Workers Welfare Board collects 1% of the actual construction cost from the employer as cess to distribute various benefits to the workers. Cess is levied as per the Cess Act, 1996 under the Central law. The important features of the Kerala Building and Other Construction Workers Welfare Board are the following: It provides various welfare measures to the workers in the construction sector by administering the fund collected by means of cess and also to implement new schemes and to ensure the welfare of the workers. The Board is running a ‘Snehasadanam’ with a view to provide shelter to the pensioners of the Board who are homeless and destitute. The Board developed a “GUEST APP” which is intended to register migrant workers into the Kerala Migrant Workers Welfare Scheme and to provide benefits.
